Expelled Yale basketball captain enrols at Belmont

An expelled Yale basketball captain who sued the school after being thrown out for allegedly raping a female student has enrolled at Belmont University. 

Jack Montague, 23, has always denied raping the female student while he was a student at the Ivy League School in 2016. 

The school expelled him over an encounter with the girl in 2014. 

She said he did not hear her when she told him she did not want to have intercourse but that he acknowledged afterwards he knew she ‘did not want’ to. 

After being expelled in 2016, he sued the school claiming the decision was unfair and is still trying to get back in to obtain his degree.

However with no end in sight to their legal fight, Montague has enrolled at Belmont in his home state of Tennessee.

‘Although Jack is still seeking, through the litigation, to be reinstated to Yale and to be awarded the Yale degree he had nearly earned at the time of his wrongful expulsion, he is at the same time trying to move on with his life, and completing his college education is a big part of that,’ his representative, Karen Schwartzman said. 

Montague had previously claimed that he was unable to apply to schools because Yale was withholding his transcript. 

The university said it would not release it because of an outstanding $3,000 tuition bill. 

It is not clear whether or not he ever paid for it but the transcript was released. 

Belmont has not commented on him joining it. Montague was due to graduate in May 2016.

After being expelled last February, he put on defiant show and continued to attend the school’s basketball games to support teammates. 

His friends stood by him and put posters up on campus suggesting he had been wrongly vilified. 

Montague’s father Jim also spoke out in his defense. ‘It’s ridiculous, why he’s expelled,’ he said at the time. 

No charges have ever been brought against the youngster.

His expulsion came as the result of a formal complaint that was filed by a Title IX coordinator who the girl told about the fourth incident.  

It triggered an investigation and numerous hearings, during which Montague insisted that all of their contact had been consensual. 

The pair had a relationship in fall 2014 and had sex four times.   

He said that one one of those occasions, she woke him up at one stage during the night to perform oral sex on him.

She agrees that they had sex four times but says she only consented to three. 

‘She told him, “Jack, no, I said I wanted to hook up but not have sex,” but he penetrated Ms. Roe over her objection,”‘ according Yale’s countersuit. 

They claimed he even apologized afterwards, telling her: ‘I’m really sorry. I know you didn’t want that.’

 Montague argued in a lawsuit against Yale that he was being used as a scapegoat for the university’s sexual assault problem.

His lawsuit against the university, which also asks for punitive damages in addition to allowing him to finish his degree, has not been settled.
