Civil servant who claimed victim’s sexual assault allegations were part of fantasies faces jail

An ‘entitled and self-obsessed’ civil servant who claimed his victim’s violent sexual assault allegations were part of her BDSM fantasies is facing jail.

Vidul Vithlani, 27, claimed he had ‘sexted’ and discussed rough sex before he arranged to meet the complainant in his car to listen to music and smoke cannabis on August 24, 2018.

He alleged the woman, who cannot be named, enjoyed taking part in fantasy roleplay, spanking and BDSM but the Old Bailey jury rejected his defence and unanimously convicted him of rape and sexual assault. 

The woman said Vithlani held his hand on her head as he forced her to perform oral sex in a car park in west London.

She admitted that Vithlani had done this before but said that this time ‘it was more violent in nature’.

‘Before it was more [like] he was resting his hand. With this one, he had a grip.’

Judge John Hillen said: ‘When giving his evidence, he came across as an extremely entitled and self-obsessed man, most of his evidence was about himself.

‘Really what concerns me is his attitude to women in general.’

The politics and international relations graduate hung his head as jury delivered their verdicts.

He was remanded in custody in Belmarsh prison ahead of sentence on 23 December.

Vithlani claimed the woman consented but he was convicted of rape and sexual assault by an Old Bailey jury following a two week trial. 

Neil Griffin, defending, read out text messages Vithlani had sent the complainant which said: ‘You can say no and you really wouldn’t stop me.’

Vithlani said he never forced himself on the woman and explained: ‘This is in the context of consensual sexual things that we like.

‘It was purely fantasy roleplay. It was sexting.

‘This was like the backdrop to us meeting.’

Another of his messages to the woman said: ‘Lol you like being told what to do. You also like putting up a fight and me just doing it anyway.’

Vithlani replied: ‘This was in the context of our consensual sexual encounters.

‘She made it clear in the early days what she liked – BDSM, being controlled.’

Reading out the woman’s response, Mr Griffin said she appeared to agree with Vithlani, reciting: ‘We both knew that from day one…I like pushing your buttons sometimes, you’re cute when you get rough.’

Vithlani admitted that during their sexual encounters he would sometimes get rough with her.

‘When she was performing oral sex on me…I would hold her, I would hold her head or hold her hand or I would spank her bum sometimes when she was giving me oral sex.

‘I had never done that kind of stuff.

‘It was not something I had actually done with a person and she encouraged me.

‘She just liked resisting.

‘She would resist, not physically or say no explicitly.’

He described how she would say things like, ‘Oh no, not yet’ or ‘What are you going to do about it?’, and that it was part of advancing the sexual encounter.

Vithlani said he always acted with the complainant’s consent.

‘I never never would have forced someone when they are outright telling me no.

‘She never actually pulled away, she never gave me that impression that she was fearful or scared and I never did anything to make her fearful or scared.’

The jury also heard a recording of a phone call between Vithlani and the woman in which Vithlani could be heard saying: ‘I’m sorry I raped you.’

Jurors also heard the former personal assistant had sent the woman a message saying: ‘You’re making my head hurt from how confusing you’re being.’

Vithlani said he was left ‘shocked’ and terrified’ following his arrest by police in November 2018.

He said that he felt ‘like a dead man walking’ after he was charged with rape but didn’t tell his parents because he did not want to ruin their lives.

Vithlani, from Pinner, denied but was convicted of rape and sexual assault.
