The ex-wife of Infowars boss Alex Jones has launched a fresh legal bid for custody of their children in the wake of his arrest for DWI, DailyMailTV can disclose.

Kelly Jones, 51, has been battling the conspiracy theorist over their children for more than six years and says she has now applied for an emergency order to get them handed over immediately.

Jones was arrested early on Tuesday morning by cops in Austin, Texas, who said he was driving under the influence of alcohol – a class B misdemeanor.

Infowars chief Jones, 45, has since claimed he was not ‘legally drunk’, had consumed a ‘small amount of sake rice wine’ at a Japanese restaurant and was ‘caught in a Travis County dragnet’.

But according to a police affidavit, he had actually consumed a bottle of sake, was ‘glassy eyed’ and had become involved in an altercation with his current wife Erika who had earlier called the cops to report a ‘family disturbance’ at their home.

Speaking to DailyMailTV, Kelly said she believes her three children are in danger from the couple and now wants the two youngest – who are minors – returned to her immediately.

She said: ‘There are emergency concerns for the children’s safety including Alex’s DWI arrest and the domestic violence and mental health instability revealed in those arrest reports.

‘Alex has been withholding the children for months, including leaving the country and leaving the children with unauthorized adults who I do not believe are safe.

‘He has done this in violation of the law and of court orders.’

Kelly previously accused Jones of brainwashing their children and of trying to ‘annihilate me financially and ruin my life’ via litigation in an interview with DailyMailTV in January.

In the exclusive interview, she painted a portrait of a dysfunctional marriage where a frequently inebriated Jones lurched from crisis to crisis and spent most of his time watching himself on TV.

She revealed how he would call her ‘Dairy Queen’ and ‘DQ’ in a disparaging reference to her weight and never changed a diaper or gave their three children a bath.

Kelly told how her ex-husband’s paranoia affected every aspect of their lives, from not being allowed to fly because of his concerns about TSA to being banned from vaccinating their children because of his antipathy to western medicine.

He insisted that she home-school their three kids but then undermined her efforts by repeatedly telling them that education ‘doesn’t matter’.

And she claims that Jones showers their children with expensive gifts such as Tiffany jewelry that they then lose, while keeping their cellphones locked up so they cannot contact her.

Kelly was already suing the Infowars boss in a bid to enforce the shared custody ruling handed down by a Texas court in December 2018 – which she claims he has ignored.

In the most recent documents, filed on December 30 2019, she claimed he has gone out of his way to keep them from her with the aim of destroying her relationship with them and is also deploying ’emotional abuse’ to get them to comply.

Attorneys for Jones have told DailyMailTV that he wholly denies Kelly’s claims of emotional abuse and has complied with the 2018 ruling.

Kelly and Jones married in 2002 after three years together when she was pregnant with their eldest son Rex, now 18.

But she says the flaws in their relationship were clear from the start, telling DailyMailTV that Jones, 45, isolated her by telling her friends didn’t like her and her family didn’t care about her.

She claims he also controlled her financially and through their children, with the mom-of-three expected to work 15-hour days on the fledgling Infowars while also caring for the family.

Kelly said: ‘When I first met Alex, he lovebombed me. It’s this love where you really feel like they’re into you but that was already disintegrating by the time I married him.

‘Alex was really in awe of my abilities, of my talent and work and that I spoke all these languages and that I could play a Brahm’s Rhapsody – he didn’t even know what it was then.

‘He was proud of his association with me, he would show me off to his friends. I don’t think it was ever symbiotic – I think it was strategically planned, slow boil.’

Just six months after their son Rex was born, Kelly was pregnant again with a daughter, now 15. A second daughter, now 11, followed.

But Kelly says Infowars dominated their lives with Jones rarely at home and, when he was, emotionally distant from her and the children.

She said: ‘He was absolutely uninvolved with [the children]. He was interested for a bit when Rex was born and for a little bit with my [oldest] daughter but the reason I stayed with Alex so long was that he was never there.

‘He didn’t have an ongoing relationship with them. He wasn’t involved in any of their basic care, he didn’t attend any of their athletic or school events, he was totally uninvolved with them.

‘I’m not sure if he ever changed a diaper. If he did, it would have been Rex’s if at all but no, he never woke up once in the night with any of these kids.

‘He definitely didn’t change the girls’ diapers or give them a bath or anything like that. None of the things people normally do.’

He also imposed his eccentric beliefs on the family, even insisting that they only travel by bus to avoid TSA.

Kelly says that he purchased a tour bus for family vacations, although most trips would also involve frequent stops to make videos for Infowars.

And rather than helping her care for the children, he would spend any spare time drinking and listening to heavy metal.

‘The whole time I was with Alex, he never let us fly in an airplane because he was so paranoid about TSA,’ Kelly told DailyMailTV.

‘So he bought this tour bus and anywhere we traveled, we’d have to drive in this crazy tour bus with this guy who worked for Alex who was a kind of sycophant who was the driver.

‘Alex would sit there and drink and listen to heavy metal, while I was in the back with three kids trying to sleep on a beer bed. It was awful.

‘We went to New Mexico one year with his parents who totally enable him and endorse all of his behavior and we went to Carlsbad Caverns and that’s an opportunity for him to do a video for Infowars.

‘We’re driving to wherever it is we’re going, he pulls over and does some big video about something.

‘And then we get to the hotel, in the morning, he’s on air so loud we’re being threatened to get kicked out of the hotel.

‘It was always like that and there was always some crisis and it’s the cult of me watching me all the time – me being him. It was horrible. That bus was horrible. It was so horrible.’

According to Kelly, the marriage was in freefall – she says she first tried to leave in 2005 but only succeeded in doing so a decade later.

Jones would routinely belittle her and, she claims, would sometimes be physically violent – and would also scream and shout at her in front of the children.

‘He definitely had no problem being angry and upset with me in front of them,’ Kelly said. ‘He made me feel worthless and isolated me from friends and family and tore me down as a person.

‘Alex, by the end of the relationship, he was calling me things like Dairy Queen – DQ – in reference to my weight.

‘But at the beginning, it was more like, your friends don’t like you, your family doesn’t care about you, they’re all crazy.

‘He’s like a professional programmer, he’s an influencer, he’s a manipulator. I was an accomplished person but in isolation and with constant attacks on your person…

‘He made me believe I didn’t understand what was going on.’

Now Kelly believes he is focused on turning their children against her by telling them ‘lies’ such as that she was investigated by the FBI for terrorism and by overseeing their communications.

Kelly said: ‘He controls all their communications. He locks their cellphones up in a safe.

‘He’s telling them direct lies about me such as when one of my children asked me if I’d been investigated by the FBI for terrorism, for bombing and I was like, no. it’s as overt as that.

‘It’s telling them what they have to say to their therapist. He also isolates them from me by telling them I don’t have any parental rights over them.

‘For the past three months, my kids’ phones have no voicemail set up on them. The only phone they can use is in the middle of the kitchen and it’s a corded phone. When my daughter has her cellphone, she’s being watched.

‘There’s no privacy. They have to line up and it is complete coercive control. I told my daughter I would protect her and she said he’s a powerful man who can influence minds. It’s terrible.’

The mom-of-three says her kids are plied with expensive gifts such as designer bags and Tiffany jewelry, while Jones threatens to cut them off financially if they cross him.

‘A few years ago, my daughter told me she didn’t think women should be judges,’ Kelly said. ‘She told me women shouldn’t be president. My daughter told me that.

‘My kids have been raised to make racist statements. Alex is a racist person and so my boyfriend Hugo, I’ve been with him for five years and he’s from Mexico.

‘I have walked into the room and heard my daughter say terrible things about him being Mexican to one of her friends.

‘I’ve seen her making fun of him to Alex because of that. I also know that she really likes him so I think they’re conflicted. They’re pretty overt about those things.

‘They’ve been made to see that as a badge of shame on me that I’m dating someone of another ethnicity. I don’t see him like that, I just see him as a really good man.’

Kelly says that she believes Jones is trying to silence her through litigation – which at one stage cost her up to $100,000 per month – and would like to see her financially ruined.

She said: ‘He’s got the money to keep suing me and Texas keeps letting this go on – he could well bankrupt me.

‘His goal is to destroy me by telling lies about me on his show which the kids can see. His goal is to annihilate me financially and to ruin my life.

‘His real goal is to control me because a narcissist cannot bear it when somebody leaves them.

‘I’ve been in so much litigation and got such a desultory settlement, I can’t even afford an attorney anymore.

‘I can’t even afford the court costs but I’m not going to stop. Last time I was in court, it was me versus three law firms but I’m going to do what I can. I just want a normal life.’
